Collab between Attorney/Client & PLoS Team

Teamwork, followed by time management, is an essential ingredient of active legal research. As our team is familiar with traditional research commercial databases (e.g., Westlaw / equivalent) that provide references indicating cross-references and validity of court decisions and related legislation, we take a shorter time conducting targeted legal research. By repeated use of search engines, our team has developed proficiency in search skills and can narrow the searches to the specific needs of the case.

PLoS conducts legal research in the following five steps:

1. Brainstorming: The Attorney/Client and the Single Point Of Contact [SPOC] of PLoS orally discuss the case, analogical reasoning, and the key issues.

2. Memorandum Of Points And Authorities is drafted by PLoS after going through the supplied case documents’ key facts.

3. Legal Standard: We research Mandatory/ Primary / Binding decisions taking into the key points and the jurisdiction using commercial databases (e.g., Westlaw / equivalent).

4. Toddler and Teenager test: Our legal research analysis passes two tests (i) Toddler, who asks, “Why, why, why”?  Our examination anticipates a “why” from the reader after we cite a legal standard and, subsequently,  provide an explanation in response; AND (ii) Teenager, who says, “So, what does that mean”? Our analysis also anticipates that the reader will want us to explain the relevance of the legal standards cited by us, especially the relevant vital facts and applicable laws/rules.

5. Rule Synthesis & Multiple Issues: We synthesize the court findings and create ONE single rule out of the two/more different (but consistent) holdings articulated in the two/more cases researched; which leads to two/multiple-element legal authority; wherein each element is addressed separately by stating principle/holding, facts, and rationale/reasoning in the precedent case. After that, we deliver the persuasive legal drafting with formal citations to the Attorney/Client.
